Tier 1 Visa (General) Migrant Scheme - Maintenance Requirement

On 30 June 2008, the UK Border Agency (Home Office) implemented the new Tier 1 (General) Migrant visa category to replace the HSMP visa scheme for skilled applicants under the new Points Based System (PBS) globally.

Switching into the Tier 1 visa category from within the UK is permitted if you hold valid leave under one of the following categories:

• Work Permit holder
• International Graduates Scheme
• Student
• Fresh Talent: Working in Scotland
• Postgraduate doctor or dentist

Alternatively, if you currently reside in the UK as a Working Holidaymaker, you are not eligible to make a Tier 1 application from within the UK. Instead, you will be required to make an application in your country of residence. This brings us to the important point of this correspondence – the newly introduced Maintenance Requirement.

Under the Tier 1 (General) Migrant scheme, visa applicants are required to demonstrate that they have sufficient funds in savings to support themselves in the UK. To do so, they must provide specified documentation demonstrating that a sum of at least £2,800 - or the equivalent thereof - has been held and maintained, as personal savings, over the three month period immediately preceding their visa application. If the main applicant is including dependents in their application, the main applicant will require additional funds of £1,600 per dependent to have been maintained as per the above.

Part way through the process - If you have received or are awaiting an HSMP approval letter issued under the HSMP out-of-country transitional arrangements, you will still need to satisfy the maintenance requirement detailed above. In this instance, you will automatically be awarded the 75 points required to qualify under the attributed points assessment of the Tier 1 (General) – highly skilled worker and the 10 points required for English language; however, you would still need to score 10 points under the maintenance section.

I would like to apply for a tier 1 visa, I have all the necessary requirements, but I have not had 800 pounds in my account EVERY SINGLE day for the past three months. Do you have a solution to this issue?

Unfortunately there are no 'solutions' to avoid the maintenance of funds requirement, as this mandatory. Sorry we could not be of more assistance in this instance.

Before I submit the application I have one quick question.
I am of Indian nationality, working in the United States on a work permit (H1 B). I did Master's in the US and I qualify to the Tier 1 program with 110 points. My question is, even though I am not a citizen of the US, can I still apply to the Tier 1 program from USA or should I apply from the country of nationality which is India.

Please advice me in this regard.

I am Planning to apply for Tier1. Can you please clarify some of my doubts below:-

1.For Maintainace fund is it compulsory to show savings account or we can show Fixed deposit also..

my IGS visa expires at the end of this month. i just found out that i have to have 800 pounds last 3 months. i have now almost 3000 pounds last 1.5 month? if i aply , would i get the visa? i dont want to get rejected. what should i do?can i appeal if i get rejected? can i show them a statement at the appeal day a statement showing more than 800 pounds?or would then consider my the date i send my documents??

I have a Valid tier 1( Migrant) Visa valid till Jan 2012, I arrived to the UK on 26 January 2009 with the purpose of searching for Job but due to the economic circumstances in that time I decided to keep MY job here in Saudi Arabia as a financial Analyst till I can decide about the best time to settle in the UK. I stayed there for 20 days only then I travelled to Morocco where I got Married there and my wife Joined me in Saudi Arabia , then I applied for Tier 1 Dependant Visa for her but was refused as the ECO said that " Your Husband failed to get employment and you dont have sufficent Funds. I have requested an Administrative review on 30 Jun where I mentioned that Tier 1 General Visa Holder supposed to have the right to search for job within the time limit of the Visa Granted and that I submitted a bank Statment in GBP and I think the ECO didnt note that and assessed it as Saudi Riyals (4,500).. My questions are : Do the main applicant have to arrange a Job in UK first before his depnedant can Join or they can be granted a Visa as long as there is SUFFICENT FUNDS for them regardless if the main applicant have a Job in UK or not ?

Hello,
I already got my tier 1 migrant visa and so is my wife but my two children were denied on the ground of insurficient maintanance funds.i was in the uk may 2009 but i had to come back to nigeria for my children. i had maintained a minimum of 1,900,000.naira.in my account since 24/07/09 but this money includes a loan i had obtained on my property from my bank.please can i now apply for visas for my children?.
1,900,000. is equivalent to 7600pounds at the exchange rate of 250.naira to one pound.
please i also want to find the current OANDA exchsnge rate of Naira to British pounds.

Hello,
My husband has gone to UK as tier 1 general migrant.I and my daughter filed dependent visa but is refused as the bank account which has got funds is linked to term deposits .they say these are not cash funds but this funds are always readily available so are cash funds and earlier also visa have been approved on these type of bank accounts.can u help me how should i appeal and long it takes to appeal and then how long it takes to get the response.what is the process or what is best for me in this situation.please help me i depend on on u .

Hi,

I am about to apply for the Tier 1(general) and I am wondewring if it is ok to present 2 savings account with a combined total of more than £800 pounds every day for more than 3 months as proof of the maintenance funds or does it have to all be in a single account.

The maintenance funds can be in a combination of accounts, as long as the total balance does not dip below the required amount on any day in the 3 month period concerned.

Dear Stephen Atkinson

I just want to query one thing about the maintenance requirement for the Tier 1 Visa? I am accumulating savings for the purpose of applying once I've completed my Masters BUT should I not accumulate enough savings, may I or one of my family members take out a loan to cover the outstanding amount? A personal loan would leave a lump sum in my bank account and thus for all intensive purposes I will have access to these funds as cash funds. I plan to sell my car once I have been granted the Visa so the loan will then be paid back in full before I actually depart for the UK and I would have more than enough funds to sustain myself by using my intial savings. But I know that when I applied for the Working Holiday Visa in 2007, the maintenance funds were not allowed to be a loan and I had to submit evidence to prove that my father had those funds freely available and that he had not loaned the money in order to give to me. Does the same apply for the Tier 1 Visa? P.S. I am writing from South Africa

Thank you for your enquiry.

Unfortunately under Tier 1, the maintenance requirement is mandatory.

If you wish to utilise your parent's account, you must be named as a joint account holder for the entire 3 month period in question.

I have got tier ,1 general visa in August, 2009. I applied for my wife as a dependant and she also got her Visa in October,2009. Now I wish to apply for my 8 month old son. What maintainence funds I have to show for filing his application?
We are planning to go to UK in January,2010.
There is a lot of confusion that whether it is 2800 or 1600 or 2800+1600+1600 GBP.
Please help.

Thank you for your enquiry.

In your child's application you will need to demonstrate £2,800 for yourself, plus and additional £1,600 for each dependant accompanying you to the UK.

Based on your circumstances, this would be £2,800 + £1,600 + £1,600 = £6,000.

Hello,
My husband is in UK (london) for the past 15 days and searching for a job. He is holding a Tier 1 General visa upto 2012. I also have a tier 1 dependant visa. Can I apply the dependant visa for my son as my husband can't come now? How much funds I have to show? Can these funds be shown in my account?
For the time being, can I get my baby a visitor visa and take him along to UK for 4-6 months, after which I will get a tier 1 dependant for him.

Hey,

I'll be applying for HSMP Tier 1 General Visa in 1st week of Jan. I have a query with regards to the previous earning clause.

Till Apr'09,I was with Infosys & I have all the payslips,bank statements & TDS certificate till that period. After that I was working as a FreeLance Consultant in Delhi, & got paid once in cash every month.I have the TDS proof for whole of that period but no bank statements as such.I can get a proof from my employer confirming the cash payments.

Will that be suffice as a proof for my previous earnings? Kindly advice...

Maintenance fund question -

1. I am currently within the UK on a work permit.
2. Intend to apply for Tier 1 switch in Nov 2010 end.
3. My bank balance over last three months has falled below 800 GBP
4. However during the durations (in the last 3 months) when it was below GBP 800, if i consider my bank balance in indian account in indian rupees converted to GBP, the total balance was more than GBP 800.
5. Will home office consider me supplying my UK and India bank account statements as a proof of maintenance funds?

Hi,
I am applying for tier 1 visa and I have maintenence funds of £800 for the last three months,but the account in which my salary comes is in overdraft. And I assume I will have to show my 12 months statement of salary account as well.
But it has always been in overdraft as it has a very low overdraft rate.So will I get maintenence funds points as my other account is got £800. Will it matter if my salary account is in overdraft.Please advise as I will like to apply visa with you guys.Thanks

If me and my dependants are applying for the Tier 1 Post Study Work Visa separately is it alright to provide proof of funds from the same account so long as the total is enough to cover all of us i.e £800 for me and £533 for each of them or this would only be taken as proof for myself only and i'll need to have a different account with funds for them alone?

Hi,

I am in the Uk on a Tier 2 visa and wish to convert it to a Tier1 visa.

I qualify on all parameters on the points calculator.

The only snag is that the required maintenance funds balance of GBP 800 is available to me in my bank account in India.

When I convert the amount of Indian Rupees into GBP it works out well over GBP 800, but the question is will maintenance funds in my bank account in India be acceptable?

I am applying for my PBS T1 visa soon. I have had 800gbp in my savings account for the last 3 months, but before that period my balance in the savings account was 0. Is that ok? Since I've had the required 800 since 3 months or will they be bothered about the sudden 800 in the account? Cheers.

For the PBS T1, in order to prove the maintenance funds is it ok if I only send an original statement of accounts issued from the bank? Should it be accompanied by a separate letter from the bank that states that the funds were held in the account for 3 months? Many thanks.
