New Tier 1 Highly Skilled Migrant Rules - 31 March 2009

The new laws surrounding initial or first Tier 1 (General) applications were published today, where the fears that Masters degree qualifications would be the absolute minimum requirement have been realised. The minimum earnings criteria has also been raised to £20,000.

The good news is that this does NOT affect extension applications for those currently in the UK under the HSMP or Tier 1 (General) schemes. Further to this, professional or vocational qualifications such as CA/ACCA/CIMA etc will still be recognised as equivalent to a UK taught Masters degree - as long as the UK professional body will confirm such.

What you've written here is not strictly true and is definitely misleading. For first time applications you do not NEED a Masters degree, its just that a bachelor degree is no longer counted as part of the points system. Yes it is harder to get but not impossible if you dont have a Masters degree.

I am confused as to why you think the article is misleading?

I am also very intrigued to learn how it is possible for first-time applicants (not those extending their stay in the UK from Tier 1 or HSMP) to qualify without scoring the minimum 35 points for qualifications (Masters or equivalent professional qualification)?

Maximum for age = 20 points (under 28 years of age)
Maximum for past earnings = 45 points (GBP£40,000+)
Maximum for UK experience = 5 points
TOTAL (without Masters or equivalent) = 70
POINTS NEEDED = 75

I trust this is clear and makes sense.

I have 1 question:

Is it possible to extend an HSMP visa, 9months before it expires?

The reason I ask this, is because I qualify now, but may not qualify in 6 months time. (job was made redundant)

Thank you for your enquiry.

Generally it is not possible to submit an application to extend your stay so far in advance of your current HSMP expiring, as the UK Border Agency could deem this as 'invalid'.

We have submitted applications early where the client had compassionate reasons or under extenuating circumstances - however these are very few and far between.

Hi just wondering if my HSMP visa is expired next year August, and I will be age of 30, with only degree qualification, am I still qualified to apply for extention and how much money do I need to earn within the last 12 months before the visa is expried.

also what if I get offer to work in another country for 6months contract, will it effect my visa or will there be a problem when I want to apply for extention?

I am here on a HSMP which expires next year March. What will be the requirements to extend? I have a degree and have been told previously that i require 2800 pounds to be in my account for 3 months and that my wife needs to have a certain amount as well.

The 2800 pound requirement. Does this have to be dormant in your account for 3 months or the fact that your balance at the end of each month is 2800, is that sufficient.

Thank you for your enquiry.

Please note that as of today, 31 March 2009, the minimum academic requirement for Tier 1 (General) visa is a Masters degree or equivalent. Unless your post-grad certificate and diploma are considered equivalent to Masters level, I'm afraid you would not be eligible.

Unfortunately it is impossible for us to predict what the criteria for extension will be next year, as of late the UK Border Agency have amended the eligibility requirements quite frequently.

At present, the maintenance requirement is £800 for yourself and £533 per dependent.

Please check back with us again in late 2009 for the most up to date information.

Hello,
I applied for the Tier 1 HSMP visa on the 28th March 2009. I have a bachelor's in Engineering which was recognized as a valid degree in the PBS. Now that the Bachelor's degree no longer fetches any points, i was wondering if this will effect my application. My online submission was before the 31st March, though i haven't yet sent in my supporting documents. Any information would be appreciated.

Hello,
I am applying to extend my HSMP which ends 31st April. I fit all the criteria, having only had £800 in my bank account since Janurary 20th.
I am worried that once i get a final bank statement as evidence of £800 for previous 3 months, it will leave only 10 days for UK Home Office to officially receive my application. I would have been in the UK 'illegally' after 31st April during the visa process. Do they care about this? Does the official date of receiving applications start from the day it arrives to them in the mail? or once the payment has gone through?

This is a little bit tricky when it comes to professional qualifications, I'm a US CPA, does this count to a master's degree equivalent and which professional body must recognise this? Don't believe the Border Agency was explicit in stating this to be.

At this early stage, 1st Contact is unable to provide the dates on which the policy will be announced and implemented by the UK Border Agency. We will continue to update our website accordingly.

Please note that when implemented, this will only affect those who entered into the HSMP scheme prior to 03 April 2006. For those who joined after this date, the 5 year requirement will still be in place.

Hi, i would like to know i have completed my CIMA in the Uk, and am from South africa. Since my home country is not majoirty english speaking, how else can i gain my points under Tier 1 for English? Would completing my CIMA in the uk be enough? I obviously did this in english. 1. You are correct - the 2 year Tier 1 (post-study) visa will count towards your 10 years of legal residence in the UK.

2. Unless you are planning on returning to your home country to obtain a new student visa to undertake your next course of study, you would not be eligible a second Tier 1 (post-study) visa. As the current policy stands, post-graduate certificates and diplomas are no longer eligible for the Tier 1 (post-study) visa, unless the qualification is a Post Graduate Certificate of Education (PGCE).

Hi,

I would like to ask 2 questions for Tier 1 visa regarding recent changes.

1) With the recent changes, minimum salary requirement is made as 20000 pounds. Is this still applied after economic status conversion made for countries? I.e earning 10000 pounds in X country equals to 20000 pounds in England and sufficient? I have seen points calculator are using such conversion, but I am not sure if it is still in use. Could you please clarify?

2) My second question is regarding to English proficiency. I have studied in a university where teaching medium was in English. However, this university is not listed at points calculator. Can I prove my English proficiency from Naric and use it for applying to Tier 1 visa?

Any help is welcome.

Please, can you advice if I will qualify for Indefinite Leave to Remain by 2012 with the following details:

I have a Tier 1 (General) Migrant Residence Permit from
June 20, 2008 - Feb 10, 2012 (3yrs + 7months + 23days)

And I had Residence Permit on Fresh Talent Working in Scotland Scheme from Feb 12, 2007 - Feb 10, 2009 (2yrs)

In fact, can any Fresh Talent period count for ILR?

Hi there! My husband applied 4 the highly skilled migrant visa before the end of march changes took effect and he got the visa. He applied with no dependent as we hadn't had the maintenance requirement 4 me in his bank account 4 three months as we weren't sure he would get it. Since beginning of april we've had the maintenance 4 him and now me in. Is it possible 4 me 2 apply as his dependent in three months time? Thanks, nikki.

hello, stephen, i will be greatfull to you if u answer my question as i have seen someone els alreday have asked the same question.i am on IGS which is expiring this may(1 year) and i have to reapply to extend it one more year in this may. i have heard that our mininum bank balance for the last three months has to be 2800 GBP. is that tru and what else i have to submite at the time of my extension.this is seems to be very much confusing because they are keep on changing rules. thnks a lot. take care , bye.

Unfortunately there is no published list of professional or vocational qualifications considered equivalent to a UK taught Masters degree.

There is a very good chance that your PGD from the BCS is equal to a Masters - this would require you to obtain a letter from the BCS confirming that the PGD carries the same academic equivalency of a UK Masters degree.

1. All foreign earnings must be converted to GBP£, and then a predetermined multiplier is applied to those earnings dependent on the country in which they were earned.

2. Unfortunately if your university and course do not meet the English proficiency as per the UKBA points calculator, the NARIC letter will not suffice for scoring the mandatory 10 points in this section. If you are not from one of the listed English speaking countries, then you will be required to sit and pass an approved English test.

You should make an attempt to enter the UK within 3 months of the start date of your visa. When it comes time to extend, time spent outside the UK is not an issue - it does become an issue when you wish to apply for Indefinite Leave to Remain (permanent residency).

I do have a HSMP visa, which was approved back in early Feb 2008. I briefly entered the UK within the required time frame, but have been working abroad ever since.

Do you know if claiming foreign earnings on the switch/extension application is likely to affect the outcome of the decision at all, given that they seem to be discouraging extension applications from overseas (with regards to the bachelors requirement anyway)?

Also, would applying 5 months before the HSMP expiry date also be deemed as 'invalid'?

Hi Sue,

Foreign earnings can be claimed as part of an extension application from HSMP to Tier 1, however, the uplift is not applied in these extension cases. Remember, an extension application must occur inside the UK. Should you apply from abroad, this will be a fresh grant of entry clearance under Tier 1.

In addition to this, applying from abroad for a new Tier 1 visa will require a Masters degree qualification, so it is in your best interest to re-enter the UK and apply for the extension from here, otherwise, you would not be eligible.

The earliest in which one should apply is when you are within 4 weeks of expiry.

1. You should only apply for an extension from HSMP into Tier 1 (General) when you are within 4 weeks of your current HSMP expiring.

2. The end balance of your account on each and every day for the entire 3 month period prior to application must be at least £800.00. So if it drops below £800 during the day, you must ensure that by the close of business that same day that you deposit funds to ensure the balancer at the end of the day is at least £800.

a) Can I apply for renewal immediately?

Hi Stephen,
I am currently on Post study visa which is expiring by the end of nov09.
I applied for HSMP before 31 march 2009 actually i posted on 27/03/09 and they recieved on 30/03/09 .The payment was gone through got an acknoledgement on 1/4/09.

today 15/04/09 i recieved a letter with all my documentation saying as invlalid and the reason was

"The application or claim must be made using the correct specified form"

which i did
i dont understand why my application was invalid

Any suggestions to re-apply by making a fresh application or check with homeoffice it seems the caseworker did a mistake .

and one morething for new application after 31/03/2008 will the total earnings should be grater than 20k as i moved to different job for the first 3 months my pay was 18k per annum and rest of the months was 25k per annum

I got my visa stamped for Tier 1 general visa on April 9, 2009
Please advise what is date before which i should enter UK.

Please advise if i can enter UK after 6 months from date of visa issue.

If that is not possible, please advise what is minimum period for which i need to enter and stay first time when entering UK.

Thank you for your enquiry.

a) You should only apply for an extension of your HSMP into the Tier 1 (General) visa when you are within 4 weeks of the current visa expiry. If you apply early, the UK Border Agency may consider the application as invalid.

b) Unfortunately you cannot extend a visa from outside the UK. This would be considered a new application and you would have to meet the requirements of a Tier 1 (General) application from abroad, which includes the new requirement of at least a Masters degree qualification and a minimum earnings level of £20,000.

Should you wish to be eligible for Indefinite Leave to Remain (ILR), commonly referred to as permanent residency, at the end of your 5 year stay in the UK, you should enter within 28 days of the visa start date.

If this is not possible, you should still make every effort to enter the UK within 3 months of the start date of the Tier 1 (General) visa.

Hi Stephen,

I have entered in UK in October 2008 under Workpermit and then later on I applied for Tier 1 visa from here itself in UK and got it approved in Jan 2009 which is valid till 2012. The thing is I haven't tried for any job over here till now in UK as i feel it is safe to work with my existing employer for few more months under workpermit(which is till valid 2011) coz of recession. So you can see that I haven't used my Tier-1 visa till now so will that still be valid after six months period or should I have to switch the job so as to use my tier-1 visa? Please help me out, you comments will be great help to me. To clarify you, I am still working in UK but my employer doesn't know that I have a Tier-1 visa as well.

Thank you for your enquiry. Just to let you know, the reason you could not see your comments is that as the moderator of this blog, I must approve all posts prior to them going live on our site.

To answer your query, in actual fact, your work permit is no longer valid - it was superseded when your 3 year Tier 1 visa was endorsed into your passport. As it stands, you are currently in the UK as a Tier 1 (General) migrant, not a work permit holder.

You should inform your employer of your change in visa status, as they should inform the UK Border Agency of the premature termination of your work permit. There is no need to change employer or job - you are still permitted to be employed by the same company you had been working for with your work permit, simply you now have the freedom to move should the need arise.

Hi Joseph,

If you do not enter the UK within 28 days of the start date of your visa, after completing the 3 year initial Tier 1 (General) visa and then the 2 year extension, you would not have met the residency requirement of having lived in the UK for 4 years and 11 months by the time your 2 year extension is due to expire - this means that at the end of this extension, you would need a further extension to reach the qualifying residency requirement.

Professional membership of ACCA should score 35 points, as it is considered academically equivalent to a UK taught Masters degree for the purpose of Tier 1 (General).

Hi Joseph,

Please refer my answers below:

1) Your wife's visa is totally dependent on your immigration status in the UK. What ever you do (ie when you extend or leave the UK), by default the same occurs to your wife's visa. Your wife cannot extend unless you as the main visa holder apply and are successful.

2) No - inside the UK at the same time as you.

3) Your wife's visa is valid for entry into the UK until 07/04/2010. However, your wife must be in the UK at the time you submit your application to extend.

I am not interested in extending visa after 3 years.

Now since it is recession period, If I plan to enter UK after 8 months, meaning landing in UK for first time, will there be any problem to enter or will my visa be invalid. Please advise

Thank you for your query.

There should not be a problem entering the UK 8 months into your Tier 1 visa validity. However, the decision to allow entry to anyone holding any visa type is at the discretion of the immigration officer at any port of entry to the UK.

I recently got my Tier 1 G visa refused because the last 12 DAYS bank statements were print outs from the online account (Yes, it was a mistake from my side). I was given NO right of appeal. Now that I have the original bank statements, is there anyway I can challenge the decision or at least ask for appeal rights?
PS: At the moment, I do not qualify for the new rules as it requires master's degree.

Do you know if the UK Government intends to review these new requirements for migrants to acquire a Highly Skilled Migrant Visa at a later date based on the feedback from migants, feedback from relevant UK authorities and bodies, and analysis of the effects of these changes on industry over time?

I am in a position where I am currently working in the UK on a Working Holiday Visa, but currently I qualify under the old points system to transfer over to a Highly Skilled Migrant Visa. (I guess I have false hope that the UK government might switch it back to my advantage!).

Thank you for your enquiry.

The MBA from a recognised UK University should satisfy the English language requirement.

The Tier 1 (Post-Study Work) visa does count towards your total residency requirement here in the UK should you be aiming to apply for Indefinite Leave to Remain based on 10 years of long residency, however, it does not count if you are considering counting the 2 year PSW plus 3 year Tier 1 (General) as the 5 year requirement for ILR.

1) Your child will not be born a UK citizen. your child can be Registered as a British citizen once you become settled in the UK (ie hold Indefinite Leave to Remain).

3) Unfortunately you are not entitled to any public funds or benefits until you become a permanent resident of the UK.

Please refer my answers below:

1. There should not be any problem entering the UK 6 months after your visa has started. This will however mean that you will not be eligible for ILR at the end of the 2 year extension to your Tier 1 visa in April 2014. As you have mentioned, you will require a further extension to meet the residency requirement.

2. Your age has no bearing on an application for Indefinite Leave to Remain (ILR).

3. Under the current rules (I cannot predict what these will be in 5 years time), you should not spend more than 6 months outside the UK within the 5 year period and specifically, no more than 3 months consecutively.

Again it is impossible for us here at 1st Contact to predict what the law and policy will be so far in advance.

My question was, my HSMP visa would expire in March 2010. How many days earlier can I apply for renewal and the answer you provided was, a month before expiry.

However, the official website details at www.ukba.homeoffice.gov.uk/.../ say that you should apply as soon as possible and before your current leave runs out.

1) Under the current rules, you should not be outside the UK for more than 180 days total, and specifically no more than 90 days consecutively.

2) As above.

3) To be eligible for ILR at the end of 5 years, you should enter the UK within 28 days of the start date of your visa.

4) As your extension is not due until 2012, it is not possible for us to predict what the criteria will be at that time.

1) A Masters qualification scores more points than a Bachelor degree. More importantly is that you meet the earnings criteria at the time of extension.

2) As long as you enter the UK within 28 days of your visa start date and spend no more than 6 months outside the UK in the 5 year period and specifically no more than 3 consecutive months, one is eligible for ILR on the current rules.

I am currently on a Tier 1 visa (which i got in April 08, and valid till May 11). I dont have a Post Grad degree, my current age is 31 (will be 32 soon) and I earn more than 60000GBP per annum. I have been in UK since the last 3 years (almost).

Will I be able to apply for my extension in 2011 and will the new Post Grad rule affect my renewal?

Also, will an online MBA course or CIM certified course from UK be considered as a Post Grad Degree when I re apply?

Please refer my answers below:

1. With any professional qualification or membership, this must be recognised by the UK professional body as being the equivalent academic level of a UK taught Masters degree. In this case, the relevant body would be the UK Law Society.

2. If you are successful in obtaining a Tier 2 visa from home (yes - this must be applied for back in Oz!), you would only be able to then 'switch' into Tier 1 should they relax the requirement back to Bachelor degree level.

Since April 2007, I am on a work permit which is till 2013.Unfortunately,I was made redundant on 31st March 2009.And in that case I know, that the said work permit doesnt hold good without employment.Should I look for a new employer, how much time do I have? Hi Stephen,

I have a Post Graduate Diploma (my top most qualification) and I want to get that assessed by www.naric.org.uk.

As per my understanding the recent rule change requires a Master's Degree.

So if UK NARIC certifies my Post Graduate Diploma as a Master's Degree equivalent then is it sufficient for me to apply for the Visa or will it only help me to gain extra points.

I.e. does my assessment hold good for the mandatory requirement or does my assessment only boosts my points?

I am sorry to hear of your redundancy.

As you are currently governed by the work permit regulations, you should seek a new employer and submit a Tier 2 application within 28 days of the last date of your employment with your previous sponsor.

Technically, if you were unable to secure a new Tier 2 visa within the 28 day period, you should seek to depart the UK as soon as practical.

Hi Mohammad,

You cannot obtain a student visa, now called Tier 4, from within the UK if you are currently here on a Tier 1 post-study work visa.

Should you obtain a Tier 4 visa from your home country and then complete your Masters degree here in the UK, you would then be eligible to apply for a new Tier 1 post-study work visa.

I will like to know if I can send in an additional document for my tier 1 general application. the document i hope to send is not for me to claim point but there is a salary charge deduction on my net salary being creditted into my account so there is a difference of about 200Naira from my payslip net pay and bank statement credit amount. The thing is that I am also enrolled in a PhD programme, and I will need 1 year to finish it after I have applied for the visa. Is it better to apply as soon as possible on the basis of a Masters and the earned salary? Or would you recommend to use the provision about the 12 months full-time study and apply later (thinking of future extensions, residency etc.)? 1) Unfortunately, no. As of 31/03/2009, Bachelor degrees now score 0 points for Tier 1 visas.

There is a small amount of discretion involved in applications for ILR, as long as you demonstrate that you have continually and clearly been based in the UK and have met all the other residency requirements in place at that time.

It is always possible to obtain additional Tier 1 extensions if you meet the eligibility criteria at the time of application.

It is not ideal to be a full time student whilst in the UK as a Tier 1 migrant, as this is a specific employment category visa. Should you not be employed for a long duration, this may cause difficulties when you wish to apply for permanent residency.

I have obtained my visa on the basis of becholar degree in commerce and professional quqlification ACA from India.

To score points for professional qualifications, you will need to obtain a letter from the UK professional body which confirms the professional level as being academically equivalent to a UK taught Masters degree.

I have 3 year visa(Tier1 general) from April 7,2009 to April 7,2012..But My wife visa(Tier1 general-dependant) was April 7,2009 to April 7,2010(1 year) only.

As your advice,3 days before i went and give my wife's passport (VFS) to extend the visa expiry..Now we are in India..Today We got Passport and my wife visa expiry date is same as my expiry date (till April 7,2012)

Hi,

I am on a PSW visa which expires Dec09. I wish to apply for the Tier1 General visa and I have checked that my points are exactly 75 on the online points calculator. I need to know how early can I apply for this as the UKBA recommends to apply no more than 5 weeks before the expiry of current leave. They keep on changin rules very frequently and I am concerned if they make any more changes by October, I might not be able to score the 75 points at that time. Can I apply a few months before the current leave expires ? Will that have any negative impact on my application ?

Can someone help me with a query. I'm planning to apply for Tier 1 General (I'm on post study work permit at the moment). I've recently got fined 60 pounds and 3 points on my UK driving license for exceeding speed limit (30 mile/hour). Does this disqualify me for Tier 1. I wonder if you could help me. We employ a member of staff who is in the UK on a Tier 1 visa. He now wishes to bring his wife and child over from Zimbabwe. He has asked me to look at the maintenance requirements with him. We are clear that he has to have £1,600 in his bank account for each dependant for 3 months (ie £3,200) unless he waits until he has been here a year when he will need £533 per dependent. We are unclear however whether he has to have an additional amount in his bank account to demonstrate he can support himself as well as his family. If so is that amount £800 or £2,600 or some other amount.

Just want to let you know that HO not consider a invalid application if you put forward your application much earlier than expired time. I have done it and got extension too. Could be lucky.

Thank you for your comment.

Please note - the acceptance of early Tier 1 applications is purely at the UK Border Agency's (Home Office) discretion.

The problem you now face is that you will not be eligible for ILR until July 2012, on completion of 5 years residence on a visa status that leads to settlement. Unfortunately temporary status such as working holiday (WHM) does not count towards the residency requirement. In November 2011 you will need to apply for a further extension under Tier 1 to reach the qualifying period in July 2012. Hence why it is not recommended to apply so early for an extension.

There's a big confusion whether the US Masters Degrees are qualified or not. And nobody seems to clarify this issue.

I got a US Master of Science degree in IT. Using the PBS it is not awarding any points. So, I requested NARIC to evaluate my degree (provided my trascripts with a cover letter describing my study).

I recently received a NARIC comparability letter saying it is comparable to UK taught Masters Degree. Would this be sufficient for 35 qualification points?

I came to UK in April 2005 on work permit. I switched to HSMP in Feb 2007. I am on Tier1 visa as of now from Feb 2009 which is valid upto Feb 2011. I should be qualifying for ILR as per the curent rules in April 2010. Can you help me with the following :

Due to current economic climate , I will be loosing my job next month. Please let me know :

1) Is there any continuous employment requirement for Tier 1 to be eligible for ILR ? How long can I be out of job as tier1 visa holder before I can apply for ILR in March 2010?

2) What should be the minimum salary earned during the last year before applying for ILR considering that my Tier 1 extension was given in Feb 2009 ?

3) If I am not back in job by Dec 2009 and cant apply for ILR by March 2010, will my clock reset and will I need to work for next 5 years continuously to apply for ILR?

My company is sending me outside the uk on a secondment for 12-18mnths where I will still be a uk employee but not on uk payroll. Hi,

I am confused about the minimum 20000 GBP requirement.
Can the same multiplier that is used for calculating points from previous earnigns be used to calculate my salary for the minimum earnings purpose?

Example: I earn 4000 NZD...I would get an equivalent salary of 35383 GBP for the purpose of earning prior earning points. But the actual converted value is 15385 GBP.
Which value do I use for the purpose of "minimum of GBP 20000 in earnings?"

i was working for a company for 3 mounths last year june.i had submitted the requied docoments from that company.After appling i came to know that company is closed.
what can i do now ? is the HO going to consider it as deception ? as now they will not be able to verify those docoments and what really i can do Frown

Under Tier 2, an applicant can claim 30 points where he/she is switching from the:

• Tier 1: Post Study category; or
• Fresh Talent: Working in Scotland Scheme; or
• International Graduate Scheme (formally known as the Science and Engineering Graduate Scheme);

providing he/she has worked in his/her present job for his/her sponsor for at least six months prior to the application, and will continue to work in that job.

This means that the employer will not need to carry our the Resident Labour Market Test (RLMT). You will still need to score the remaining 20 points required from your qualifications and prospective earnings.

Most importantly, your employer will need a Tier 2 Sponsor License issued by the UK Border Agency before they can sponsor your employment.

Should you not be eligible for an extension of your current HSMP into the new Tier 1 visa, there are only limited options available to you to remain in the UK.

I've send my application to Home Office on 19th June 2009 and Home Office tried to deduct the fee on 22nd June 10:30AM. Unfortunately for some security reasons bank has declined the fee request(My fee £820 + My Wife fee £50) and immediately bank people called me and asked for my approval which is late, now they are ready to approve the fee. HO sent me an acknowledgement on 22nd June stating they've received the application and if they find any problems with the fee payment or validity of the application, caseworker will contact me. My Visa is going to expire on 11th July 2009.

I've 2 questions here can you please answer
1) Is HO will try again to deduct the fee payment?
2) Is really caseworker will contact me if there is any problem with the fee deduction?

I have been working in the UK on the Work Permit which ends Feb 24, 2010, after 5 years. But I physically entered the UK on that visa on May 14, 2005, so my physical presence in the UK will be short of 79 days to 5 years. Can I still apply for ILR in February despite coming two months later? Or I need to apply for Tier 2 with all its headache? And I am Russian citizen, graduated from The Lomonosov Moscow State University (MGU), the best and most famous university in the country, but in 1992 when they only gave so called "Specialist" diplomas, no Masters existed. I have good salary, UK experience, fluent English - can I apply for Tier 1 instead if I have to extend my WP and cannot apply straight for ILR in February?

My current HSMP expires on the 31 July 2009. I have submitted a new application for Tier 1 on 1st July 2009. If the decision takes longer than 4 weeks am i still able to work beyond the expiry of my current application. If yes, for how long.

Hi,

I am on HSMP which is expiring on 27th December 2009. I meet the criteria except for maintenance Fund. My account stays overdraft (around £1200) all the time. It comes out of overdraft when I get my pay but slips back in to the overdraft as near to the end of teh month.

I have another account in Pakistan which have around £1600 balance. I opened this account 1 month ago. I want to know can I use this overseas bank statement to fulfill the Maintenance requirement. Secondly, when I send my UK bank statement as a prove for a salary then will that cause any problem as it will be in overdraft.

Hi Stephen,

I have done Post Graduate Diploma in Computer Science from a reputed college from India.In the Points Based Calculator it gets 0 points if I fill up my qualification as Post Gradute Diploma. So I got the letter from NARIC which specifies that it is considered as equivalent to Master's Degree.
If I fill up my qualification as Master's degree in Points based calculator, It gives me 35 points.

Please advise if it would be appropriate to specify it as Master's degree in my application form. The certificate shows "Post Graduate Diploma in Computer Applications" but it is considered equivalent to Master's degree by NARIC.

If UK NARIC have verified that your overseas qualification is considered equivalent to a UK taught Masters degree, then you are entitled to claim 35 points under the Tier 1 (General) category.

i have applied for tier 1(G).I am self employed.After applying i came to know one of the company i have worked for last year july 08 is now closed as you know alot of companies are closing and are closed. i did provide Home Office their invoice.Even though the company is closed i did provide HO accountant address and ph so that they will be in the position to do verify that as that company is now closed.what do you suggest me to do i am worried alot and it is not my fault that company is closed but i had to claim the points as i did worked and got paid.

please quide me as it is a very stressfull satuation for me

Hi,

I am currently on fresh talent visa and shall be expiring soon. I am planning to switch to tier 1 visa after this and i am unsure which category do i fall under:
a) switching your current immigration category in the UK
or
b) extending your stay in the uk

reason i am asking this is that the bachelors degree counts toward the latter( which is the extention of stay) but not the first one. i also read about, fresh talen is now replaced by post first off, does that mean by default all fresh talent holder are now post study?

Thank you for your enquiry.

Unfortunately you would be switching your immigration category, meaning the minimum academic requirement will be a Masters degree.

Furthermore the Fresh Talent: Working In Scotland Scheme is not a predecessor to the Tier 1 (post-study) visa, so you are unable to take advantage of any extension under this category.

Hi Stephen,

I will be doing a Phd in Finance at Reading, so I will be as Tier 4 migrant (General Student) from september 2009. My Phd is paid by the ICMA Center an Institution from the University of Reading. They will pay me 9600 sterling pounds for tuition fees + 15000 sterling pounds for living costs. If I pass the TOEFL ibt the next year with 110 or more and I find an extra income of 8000 sterling pounds (32600 GBP total) and I have the maintenance funds this will give me 75+10+10 points just enough for apply to HSW Tier 1. Could I apply for HSW Tier 1 from Tier 4 General student status?

As long as you meet the minimum points threshold as per the immigration law at the time of application, there should be no reason why you could not apply. Of course it is difficult for us to predict what the law will be in the future.

Hi,

I am currently on a Highly Skilled Migrant Permit visa which is due to expire in early September. I am wanting to renew this under the Tier 1 arrangement however I did not realise there was the maintenance requirement until recently and I will not have had the requisite £800 in an account for 3 months until approximately two weeks after my current visa expires.

Will I be able to apply for extension of the visa once I have had the £800 in an account for three months following expiry of my current visa from inside the UK ? If not does this mean I can return to my country of birth and apply for the extension or can you only extend your visa under this arrangement while your existing visa is still valid ?

Hi

I am a dependant on my husbands Tier 1 visa . My husband work for 6 weeks in Russia and then returns to the UK for three weeks. He has been on this rotation for the past year. He is employed by a UK based company and pays UK taxes. We have been on this visa since December 2008. Will we still be eligible to apply for indefinite leave to remain after our 5 years are up or do have to be permanently based in the UK?

I am going to extend my HSMP visa next month. I have a query.
I worked for a company in Kent till Dec 2008. And from Jan 2009 I left that company and join another company in London. The company in Kent, they used to pay me monthly like 1st of Dec to 31st Dec. But my company in London, they use to pay me each 4 weeks.
The problem is, My last pay slip shows earning till 10 July 2009 but my earning year finishes at 30th June 2008. I have to claim earning from 1st July 2008 to 30th June 2009. So how can I adjust 10days salary from my pay slip?

I wanted to apply for HSMP visa, but based on online assessment, I am getting only 65 points in total.I have a B.E/B.tech degree, with 5.7 years of work exp in software. Can you please suggest, how should i go ahead for this? how can i get extra 10 points to make it to 75 ?
In addition, My wife has done masters in physiotherapy, but since she is having just 1 yr of exp, she has got 55 points in the assessment. i am just thinking, if i can be a dependant of my wife, since she is having masters degree.

I would be ever so grateful if you can kindly answer my query:

I have been on Dependent visa since I entered UK in 2003.
Both me and my husband are doctors.
He was on Permit free training visa from
September 03-May 06.
Then from May 06-08on HSMP
then in Tier 1 from may 08.
Since the HSMP approval came before March 06, he is eligible to apply for ILR in May 10

We are now separating and I would like to apply for a visa myself(not dependant)
I am a GP . Which visa category should I apply for ?
I have been in the UK for the last 6 years as well working as a doctor .
Will my application be considered as a new application if I apply for Tier 1 ?
If yes, does being a GP qualify one for the post grad 35 points ?

In relation to the Tier 1 skilled migrant visa, you would need to hold an academic qualification that is equivalent to a UK taught Masters degree to be eligible.

Alternatively, you could be eligible for the Tier 2 sponsored skilled worker visa, if an employer (such as an NHS trust) is willing to sponsor you.

Regardless of which visa you wish to apply for, you must return to your home country to submit the application.

I seek your advice on a small confusion. I am a T1 visa holder (starting from Mar 09 - Mar '12) but I haven't been to UK yet on this visa. The current market is not that good for me to leave my current work and move to UK to search for new work. Some of my friends told me that I should be in UK within 6 month of Visa start date. Do I need to provide documentation from NARIC in addition to a copy of my academic transcript and Masters award certificate to apply for a UK Tier 1 (General) visa? Now, I understand that the date entered here is most likely to be the Visa validity start date. Is my understanding correct?

What is the maximum time allowed from the date of application? For example, if I apply in September 2009 can I state that I'd like to travel only in Mar 2010? Or is 6 months too late - is there a limit or any rules pertaining to this?

Both my husband and myself are on HSMP now. We have updated the status on our passports to HSMP from work-permit holders. However, due to financial constraint, we have not changed our children's status on their passports and they are still on workpermit which is valid till september 2010.

We are planning to visit India for a short break, but will there be any issues for our children to enter the UK on return?
Please advice at the earliest.

Thank you for your enquiry.

Unfortunately we are not able to predict what an individual Immigration Officer will say or do at the port of re-entry to the UK.

Essentially, your children should hold the same immigration status as the primary visa holder. Furthermore, technically the work permit is no longer valid and has been superseded by your HSMP, the dependant's visas are also technically no longer valid.

I suggest that if at all possible, you change your children's visa status over at the earliest opportunity.

What is the general criteria of HSMP extention when i will come to UK after 3 month period.
Do it require last 12 months status/salary and working in UK when i will go for extension?
Do it require the time i stay i UK as i might be travelling for business purposes outside the country.


In case of Permanent residence application what is the criteria of the lenth of stay in UK? How many days a person can stay outside in one year or total 5 year period. Also does it apply for the business trip as well which can be lenghty and can go for 1 month or so.

Unfortunately we cannot predict what the extension criteria will be in 2012.

Under current law, one may not be outside the UK for more than 6 months in total over the 5 year qualifying period and specifically, no more than 3 months consecutively.

I beleive many people are in situation like me, but would need clarification from you. My HSMP visa was stamped in July 2007, but I came to UK on HSMP visa in Aug 2007. This is exactly 38 days after stamping. I got my extension unter Tier 1 till July 2012. But As you see I am falling short by 10 days to complete 5 years in the UK. My question is do I need to apply for second extension or will I be qualified for ILR? If I do need to apply for 2nd one, then which rules would apply? Because I have claimed 10 points for my age during my 1st extn, but by the time I apply for 2ns extn I will get 0 points for age?

I have a typical situation of an HSMP migrant. My inital HSMP visa was granted in July 2007 and I entered in the UK in Aug 2007. Which is 38 days after stamping. I got my second extension under Tier1 till July 2012. So as you see I am falling short by 10 days to complete 5 years criteria for ILR. Do I need to apply for 2nd extension or is it okay to apply for ILR? If I do need to apply for 2nd extension then which rules do apply? I claimed 10 points for age for my 1st extension, but by the time I apply for 2nd extension, I will be scoring 0 points as I will be above the age limit set. Am I correct here?

i have been on tier 1 poststudy visa, which expires in 6 months. I am married now and my wife will be due for tier 1 post study visa at thesame time when mine will expire. Is it possible to apply as her dependent at thesame time she applies for hers, or will I need to return to my home country and apply from there?

I have currently got PSW visa and have completed bachelors in business administration.My PSW visa expires on the 31/04/2010.I am serious about pursuing MBA from a leading UNI and having checked the start dates almost all of them start in Sep 2010.I am confused as to when i apply for change in visa from PSW to student whether the home office would be OK to grant me leave to remain under student category when my course is not due to start until sep 2010? although i would have already paid half of my fees by then. What can be the outcome? I have found some colleges which start in July but i am not that intersted to pursue Masters from college..Please help..

But before I could find a job here in UK my company sent me in UK on an assignment on Tier 2. They didn't use my Tier 1 as they don't send their employees on this visa. Please advise on status of my Tier 1 visa. Would I still be able to use it in future if I get a job here in UK.

If you have a Tier 2 visa stamp endorsed into your passport after the Tier 1 visa was issued, then the Tier 2 visa has superseded your Tier 1 visa, unfortunately meaning the Tier 1 visa is no longer valid.

I am currently on a work permit(2 year 4 months remaining)linked to my employer and have another offer from a company. The new company may not sponsor my work permit so I might have to go on my husband's dependent visa(possibly Tier 1). My husband also has a work permit and is planning to switch from his company related work permit to a Tier 1. He has only been in the country for last 1 year and had tried applying for Tier 1 in Oct 2008 before but got a rejection because his english language certficate was not accepted. We tried calling to find out the exact reasons but it was almost impossible to reach them and fnally we gave up. Now he will submit a new application again. I have following 3 questions:

1: I have already been in the country for 2 year 7 months and have intention to apply for my Indefnite leave to remain(ILR)once my 5 years are over. If i change my status from work permit to a Tier 1 dependent, will my chance for ILR get hampered in any way? Will my stay in the UK under both the status be considerd for ILR?
2: Is it ok for my husband to apply again for Tier 1 so soon?
3: Will his chances for getting Tier 1 diminish in any way if I apply for switching from my work permit to his dependents visa along with his application?

I got my tier1 on 5th may 2009, i came to UK on 30th June 2009, and started a IT consultancy firm, I got a project in Qatar, so i moved to Qatar on 16th of July 2009 to do this project which will go till end of feb 2010, i make it a point to land UK once in 89 days, so i wont fall into 90 day absence

i have 2 questions

1.however by feb 2010 i would lived outside UK for around 10 months in total,what happens if i get another project and go out of UK for around 6 months...which in total will pass the 450 days in total for 5 years?

Hi Stephen,

I am planning to apply for a Tier-1 Visa but am struck with the following Delima. I have a Master's Degree which is present in the list of recognised universities (in HSMP Points Based Calculator) but does not qualify for English Language points. But at the same time I have a Bachelor's Degree (also present in the list of recognised universities in HSMP Points Based Calculator) which qualifies for English Language Points. Can you please tell me if I can use my Master's degree for Qualification Points and the Bachelor's Degree for English Language Points.

Thanks a lot for your prompt reply. It was highly appreciated. I just have one more query reagarding the points under Earning section. Is it necessary to show last 12 months proof as earning even if I am getting the required points by just showing the last 9 months earnings from UK. Actually I was working in another country before coming to UK and hence does not have the Original Bank Statements (but only the salary slips) for the rest of the period. Or can I just send the salary slips for the remaining period (as they need two proofs from different sources for claiming the earning points).
I will be highly grateful if you can provide your opinion on the same.

This is for Tier 1 UK VISA.

I am a Post Graduate diploma holder in IT and have received a letter from UK NARIC stating my qualification is equivalent to UK taught Post Graduate Diploma Standard. Now, I went to one of the documents that I found on some other site (it is an official document of UK NARIC) stating bands and equivalent qualifications under those bands. There, it has been stated that PG diploma is equivalent to Masters.

I am totally confused. Can I apply for Tier 1 UK VISA based on this fact? Can you please advise?

The earnings considered for a Tier 1 visa application must be any consecutive 12 month period (maximum) within the immediately preceding 15 months at the time of application.

Hi,
Cima Level 2 which is referred to as Advanced Diploma in Management Accounting is not listed in the qualification list of General Tier 1 Points calculator however "Advanced Diploma" is. Once you select "Advanced Diploma" then choose the awarding body "CIMA", it gives you 35 points.

Can you get 35 points by choosing advanced diploma then awarding body Cima ?

Can you please clarify whether CIMA Advanced Diploma in Management Accounting also qualifies for 35 point ?

Hi Stephen,

I am currently in the United Kingdom under an HSMP visa stamped in March 2008. I will be due for my visa renewal in the month of March 2010. I have taken the Self assessment test and my qualifications, age, previous earnings and United Kingdom experience meet the required points criteria. However I was unemployed during the month of March 2009 and will be able to provide only 11 months of pay slips. This however does not affect my eligibility for the points criteria as my earnings for 11 months (and even only 10 months) are enough to meet the criteria. Can you please let me know whether I can apply for my renewal using less than 12 pay slips.

Thank you for your Gr8 support.

I was granted hsmp in March 2008 which expires in March 2010. I recently did my masters in distance education from India, which is in Point based calculator list as qualified to be equivalent to British Masters.

My question is can i score 35 for qualification under masters section, even though i just scored 30 for graduation for my initial application.

I went to india to attend masters exams recently and i cleared all my subjects.

Your help would be much appreciated.

Hello,
I have combed UKBA website on this question and as usual found no meaningful answer so I was searching on-line and came across this very helpful forum.
I got my Tier-1 approval in July 2008. We had a baby four months ago and taking her to see her aged grandparents this christmas. We have her passport ready.

First concern is the website does not say anything about babies born in the UK. So i'm wondering what needs to be sent with the application.


Secondly, even though it will cost more, we decided to take all documents in and do same day service, unfortunately there are not available dates before mid January 2010.

To send passport in, we dont know how long it's going to take, we've tried calling the contact centres, they are never helpful.

Can you advise on any of these please.

I am curretly residing in the uk Under TIER 1 post study Work catergory more than 12 months.i need to apply for my wife seperately in srilanka as my dependent.I am going to send my bank statement for her to apply.she is not going to show her bank account.
is that ok to maintain more £1333 (£800 for my self and £533 for her because i have been in the uk more than 12 months under TIER 1 post study work visa) for each and everyday for 3 months?

Dear Sir,
I currently hold a PSW visa and my wife is with me in the UK as my dependant. I have two queries which if you could solve would help me a lot in taking some step. The questions are:
1. If my wife wants to convert her visa from dependant to student visa can she do it from UK or she has to go back to my home country Bangldesh to change the status.
2. If she manages to change her visa status to student visa and I am in PSW then can I change my status to her dependant from UK or do I have to do it from my home country Bangladesh as the new dependant form of June 2009 version says a point based immigrant cannot apply for dependant of another point based immigrant and has to apply as a fresh candidate.

I graduated (Part 2) Post Graduate Diploma of Architecture in September 2009. I need to earn at least 1 year UK experience to go on Part 3 which is RIBA Architect license. I know the Postgraduate Diplomas is not counting towards a Tier 1 (Post-Study Work) visa application. I just wonder any visa I can apply to stay in the UK right now. Also I have been to the School adviser and solicitor, they both are advising me apply another master course. I don't have extra money to pay for the another master course at all. I just feel this is unfair to know the system change in the study period. I have 4 years working experiences (not in UK) and the salary was 35,000 last year. Also as I know if i am working, I can apply Tier 2. Unfortunately Architeture field is very quiet. I would appreciate if you could get back to me soon. Thanks.

Hi stephen,

I have recieved my HSMP Tier 1 valid from jan 4 09 till 2012 but i entered UK only in July 4 2009.

I was eligible & recieved Visa with the Bachelors Degree Criteria & i do not hold a Masters.

My Concern is when applying for extension do i need to complete Masters for further stay ?

What role might my delayed entry play ?

Is there any points based calculator which we can asses for Extension of HSMP tier 1.

Please do Advice on the what criteria would Home Office would Extend the stay.

Hi Stephen.

I got Tier1 G in March 2009. I visited UK in for a month in July. And now I am here again since November. I have still not bagged a job here.

Now my question is, for how much time can I stay in UK without work?

Another thing: I might have to travel to US in Jan (work of my present company back in India; for which I am working from home). So if I go to US for say a month; when I am back.. is the Immigration Officer going to allow me to get in UK given my above mentioned status?

Could you please guide me can I apply for PSW for the second time. I am already on PSW, this year I am going to apply for Student visa and then would plan to go for PSW in order to be eligible for HSMP ( as been suggested by so many people). I will like to apply for Student visa only if I am sure that I will be granted PSW later, otherwise there is no point doing masters degree, as I will not be able to apply for HSMP visa ( being on student visa in the last 12 months). I hope I made myself clear.

Does my dependent's earnings be counted when I go for Visa Extension after 3 years of Tier 1?

Does my dependent's earnings help me anyway to get the extension?

Actually I am in no mood of working now. Or may be I do a part time job with lesser salary which wont qualify me for extension after my 3 years are over. My husband is working here in UK. He is dependant and I am main applicant for Tier 1.

My name is Pavan and I would appreciate your advice regarding an initial application for entry into the UK as a dependent of Tier 1 Migrant for my 8 month old child who is in India at the moment.

Kindly advise regarding the following :

1.Inorder to satisfy the maintenance requirement,what would be the minimum amount of available funds that needs to be shown as evidence for my son's application for Entry clearance. Will it be £1600
or £533 to be maintained for 3 months?

2.Can the required funds be maintained in my wife's Bank account in India to satisfy the maintenance requirement?

I have been in the UK for 7 years.
