Spouse/De-facto Partner Visa subclass – 100/309

This visa type is for people who wish to enter Australia with the intention of settling, and who are in a married or unmarried relationship with an Australian citizen, Australian permanent resident or eligible New Zealand resident.

The visa class is separated into two divisions, one being provisional and the other a permanent visa. The length of the relationship and the level of publicly recognised commitment will determine which class of visa should be applied for.

Spouse/De-facto Partner Visa subclass – 820/801

This visa type is for people who are already living in Australia and who are in a married or unmarried relationship with an Australian citizen, Australian permanent resident or eligible New Zealand resident.

The visa class is separated into two divisions, one being temporary and the other a permanent visa. The length of the relationship and the level of publicly recognised commitment will determine which class of visa should be applied for.

Prospective Spouse/Fiancé Visa subclass – 300

This visa type is for individuals who wish to marry an Australian citizen, Australian permanent resident or eligible New Zealand resident and have the intention of then applying for an Australian spouse visa.

This visa type will often be chosen by those people in a relationship who do not meet the requirements of the Partner Visa due to insufficient evidence of cohabitation.

New Zealand Family Member Visa subclass - 461

New Zealand citizens are permitted to live and work in Australia and therefore the partners of New Zealand citizens are also permitted.

This is a 5 year provisional visa that will not lead to permanent residence but can be renewed onshore as required.
